Only time will tell if public sector crooks have turned a new leaf

It will be a long-awaited but welcome change spurred in part by a critical report early in 2009 that called for reforms. (BULLPUCKY!)
Alberta Culture Minister Lindsay Blackett, who was instrumental in pushing for the change, recently told the Herald's editorial board that the commission is being retooled from top to bottom so that there will be "no more kangaroo courts." For too long, human rights tribunals have operated outside the normal rules of evidence that apply to regular court proceedings, leading to allegations that they are often unfair and lacking in due process, especially in controversial areas such as free speech.
"We had to change the governance of how it's run," Blackett said. "It has to be objective. It's a quasi-judicial body that has to be run like one."
Last year, the province announced the appointment of Blair Mason, with 25 years experience on the federal court, to head the commission. "We had to get a judge to . . . put some discipline in it," said Blackett.
As chief commissioner, Mason will run tribunal hearings into unresolved cases. The soon-to-be-named director -- a person Blackett says is of "top notch quality" -- will run the nuts and bolts of the commission's daily work, where the bulk of cases are resolved. Of 668 files handled in 2008-2009, only 22 cases, or three per cent, went to a tribunal hearing.
As someone with judicial experience, Mason should bring some credibility to tribunal rulings. The many flaws in the existing process were exposed in a Dec. 3, 2009, ruling by Alberta Court of Queen's Bench Justice Earl Wilson that overturned an Alberta human rights tribunal finding against Red Deer youth pastor Stephen Boissoin.
Boissoin was found guilty and fined after making disparaging remarks about homosexuals in a letter to the Red Deer Advocate eight years ago.
Wilson ruled that the tribunal overstepped its constitutional bounds and took significant procedural liberties that would have never been permitted in a real court.
Blackett says the new human rights commission will be streamlined so that decisions are made within the 190-day average of the Alberta Court of Queen's Bench. Some commission rulings have taken longer than 400 days.
If the system works as Blackett says, Alberta will be at the forefront of implementing an efficient commission with a credible tribunal process.
In Saskatchewan, the latter is so broken that the government is considering scrapping tribunals altogether and sending unresolved commission cases directly to courts, where they often end up anyway, on appeal.
We have applauded this bold approach, but are willing to give Alberta's re-tooled process one last try.
